Elie Sandwidi, doctor of law, presented his book entitled " UEMOA -ECOWAS-OHADA Community Law: sources, characteristics and judicial control" this Saturday, January 23, 2021 in Ouagadougou.
" UEMOA -ECOWAS-OHADA Community Law" is the second edition of the first book "West African Community Law" by the author Elie Sandwidi published by the Ouagadougou University Press in 2018. In this second book, the author remedies the shortcomings of the first of the point of view of technical and scientific quality and content.
It also improves the approach to the subject by no longer focusing solely on the organization, competences and procedures applicable before the community courts, such as the WAEMU Court of Justice, the ECOWAS Court of Justice and the OHADA Court of Justice and Arbitration.
The 500-page book, subdivided into 6 chapters, deals among other things with the sources of WAEMU -ECOWAS-OHADA community law, the autonomy of the community rights concerned, the organization and procedures applicable before the Court of Justice of WAEMU , ECOWAS and the OHADA Court of Justice and Arbitration.
For the author, the book including the legal concepts of community law will allow practitioners to deepen their knowledge in the application of law. "The aim of the book is to defend the cause of the rule of law and respect for the principle of legality", explained Elie Sandwidi.
The work also contains annexes such as the UEMOA treaty and the additional protocol on the statute of the UEMOA court of justice, the 1991 protocol relating to the ECOWAS court of justice and the rules of the court ECOWAS Justice of June 3, 2002, the OHADA Treaty, the Rules of Procedure of the Common Court of Justice and Arbitration of OHADA.
The book is intended for students as well as the general public. “At the university level, we are awaiting the arrival of this book which will help us in our activities and in the training of our students. It is a work which gives an overview of the legislation at the level of the organizations concerned”, rejoiced Professor Osseni Illy, teacher-researcher at Thomas Sankara University. And Master Ibrahim Guitanga, lawyer at the bar of Burkina and invited, to add that "it is a work that must be immediately made available to practitioners so that they can use it".
