The European Commission filed an appeal against the Grand Duchy before the European Court of Justice on Wednesday. If the court rules in favour of the Commission, Luxembourg could be fined daily. The delay in the draft law on the seizure of criminal earnings could be costly for Luxembourg, which will have to explain to the European Court of Justice why it has still not transposed the regulation concerning the freezing and confiscation of the proceeds of crime into its law. A directive that should be effective “since 4 October 2016”, the European Commission recalls in a press release published on Wednesday.
The executive body of the European Union (EU) has filed an appeal against the Grand Duchy before the European courts. “If the court confirms our findings, there will be a daily fine,” Adalbert Jahnz, spokesperson for the European Union Office for Home Affairs, told our colleagues at LuxTimes. The announcement of legal action comes about ten days after the European Public Prosecutor's Office took action.
